TERMS SERVICES AGREEMENT

This contract is between Stowe Farm Boarding Inc and the Owner/Client named below (Pet Owner)

This agreement relates to services to be rendered in reference to the above-named dog. Pet owner hereby requests Stowe Farm Boarding Inc. to provide certain services with respect to the Pet Owner’s dog as requested by the Pet Owner and agreed to by Stowe Farm Boarding Inc, and as described in this Agreement. Pet Owner agrees to deliver and pick up the dog during Stowe Farm Boarding Inc’s normal business hours on the dates indicated in the Pet Owner’s reservation, unless prior arrangements are made, and failure to pick up the dog as described in the reservation may result in the accrual of additional boarding and other charges, which shall be paid by Pet Owner. Pet Owner also agrees that if the dog is picked up by 11 am they receive a $10.00 discount for that day, pick up during afternoon hours will be considered a full day rate. Pet owner shall be responsible for any injury or damage to Pet Owner’s dog while in transit to or from Stowe Farm Boarding Inc’s facility.

All services shall be provided at Stowe Farm Boarding Inc’s facilities in Millbury, MA, unless otherwise indicated in this agreement. Pet Owner acknowledges and agrees that training, boarding, and other services may be provided at any location within Stowe Farm Boarding Inc and it’s affiliates’ properties, including the main campus, training and exhibition fields, and at trainer residential facilities. Stowe Farm Boarding Inc agrees to exercise reasonable care to maintain a clean, safe and secure environment for the Pet Owner’s dog while the Pet Owner’s dog is in Stowe Farm Boarding Inc’s custody. Provided that Stowe Farm Boarding Inc has exercised reasonable care, Stowe Farm Boarding Inc shall not be liable for loss or damage to Pet Owner’s dog, from any cause, including specifically but without limitation disease, theft, fire, death, escape, or injury. In addition, Stowe Farm Boarding Inc shall not be liable for harm to persons, other animals, or property caused by Pet Owner’s dog and Pet Owner shall indemnify Stowe Farm Boarding Inc from any liability for any damages caused by Pet Owner’s dog.

Pet Owner represents to Stowe Farm Boarding Inc that upon arrival at Stowe Farm Boarding Inc’s facilities, the Pet Owner’s dog is in good health and that all vaccinations are current. Stowe Farm Boarding Inc may refuse to accept (or may terminate this Agreement and require Pet Owner to immediately pick up) any dog whose health, condition, or behavior could jeopardize the health or safety of Stowe Farm Boarding Inc personnel or other animals. Upon arrival at Stowe Farm Boarding Inc’s facilities, Stowe Farm Boarding Inc will examine the Pet Owner’s dog for fleas, ticks, and other minor health problems. If health or other problems are found, Stowe Farm Boarding Inc may in its discretion either (i) bathe and/or treat the Pet Owner’s dog at Pet Owner’s expense; or (ii) refuse to accept the Pet Owner’s dog or return the dog to the Pet Owner until such conditions are corrected. If the Pet Owner’s dog becomes ill or the state of its health or conditions requires professional attention while in Stowe Farm Boarding Inc’s care, Pet Owner hereby grants Stowe Farm Boarding Inc the authority, it its sole discretion, to engage the services of a veterinarian of Stowe Farm Boarding Inc’s choice. Charges by Stowe Farm Boarding Inc or any veterinarian for services provided shall be paid by Pet Owner.

Pet Owner agrees to pay Stowe Farm Boarding Inc for services rendered based on Stowe Farm Boarding Inc’s standard service rates at the time services are rendered. Pet Owner also agrees to pay, at rates as determined by Stowe Farm Boarding Inc in its discretion for any amounts attributable to Pet Owner’s dog and the care of Pet Owner’s dog, such as special feed or nutritional supplements, special care or handling and other services or supplies provided by Stowe Farm Boarding Inc. Stowe Farm Boarding Inc may require payment in advance or at the time services are rendered or may require that payment be made before the Pet Owner’s dog is returned to the Pet Owner. Otherwise, Pet Owner will be billed for services pursuant to this Agreement and payment is due upon receipt of the billing statement. Pet Owner will pay all of Stowe Farm Boarding Inc expenses in collection, including collection agency fees, attorney’s fees and other costs. Stowe Farm Boarding Inc may refuse service if billings remain unpaid. Pet Owner hereby grants Stowe Farm Boarding Inc a lien against Pet Owner’s dog and other property in Stowe Farm Boarding Inc’s possession for unpaid charges, it being agreed that Stowe Farm Boarding Inc may at its option retain possession of Pet Owner’s dog until all charges are paid and Pet Owner shall be responsible for boarding charges during the time of possession of the dog by Stowe Farm Boarding Inc

Pet Owner’s dog shall be deemed abandoned if the Pet Owner fails to pick up the Pet Owner’s dog on the day for pick up indicated above, or if Pet Owner fails to pay applicable charges. If the Pet Owner’s dog is not picked up and all charges settled by payment within 7 days from the date Stowe Farm Boarding Inc mails to Pet Owner (to the address indicated above) written notice that Pet Owner’s dog is considered abandoned, Stowe Farm Boarding Inc may either sell the Pet Owner’s dog pursuant to Stowe Farm Boarding Inc lien rights in whole or partial satisfaction of Pet Owner’s dog to a humane society, rescue organization or other personal as an abandoned pet, and Stowe Farm Boarding Inc shall have no further responsibility for the Pet Owner’s dog. Pet Owner shall continue to accrue and be liable for unpaid charges, including boarding charges at Stowe Farm Boarding Inc’s standard boarding rates then in effect, until the Pet Owner’s dog is sold or delivered to the humane society, rescue organization or other person as an abandoned pet.

It is understood by Stowe Farm Boarding Inc and Pet Owner that all provisions of this agreement shall be binding upon both parties thereunto for this visit and for all subsequent visits. This contract, which replaces any prior agreement between the parties concerning the subject matter hereof, contains the entire agreement between parties.
